This agreement text is for informational purposes under KVKK Art. 10 and the Highway Transport Law. It does not constitute legal advice.
1. 1. Parties to the Agreement
Carrier: Elemen Transfer Turizm ve Taşımacılık Hizmetleri (hereinafter "Carrier"). Guest: The natural person who makes the reservation on their own behalf or on behalf of another and uses the service (hereinafter "Guest"). The agreement comes into effect upon completion of the payment process.
2. 2. Fee and Payment
The reservation fee is determined as a fixed price during the online payment step; traffic conditions, road closures, or time changes do not affect the fee. Upon completion of payment, a digital invoice/receipt is sent to the registered email address. VAT is included; an e-Invoice is issued for legal entities.
3. 3. Insurance Coverage
All our journeys are covered by the Compulsory Personal Accident Insurance for Road Passenger Transport (KGSTYY). The insurance includes:
- Death compensation: Annual limit (determined by the Undersecretariat of Treasury).
- Disability compensation: Proportional to the degree of disability.
- Medical expenses: All medical costs within the annual limit.
- Temporary incapacity for work: Daily compensation payment.
Additionally, the vehicle's traffic insurance and comprehensive auto insurance protect the guest.
4. 4. Force Majeure and Liability
The following situations are considered force majeure and release the Carrier from liability:
- Natural disasters (earthquake, flood, fire, storm).
- Government decisions (curfew, road closure).
- Actions of third parties (accident, act of terrorism, fault of another).
- Severe weather conditions (if the chauffeur cannot reach the destination safely).
In these cases, a 100% refund is issued, or the right to a complimentary transfer on another date is granted.
5. 5. Dispute Resolution
The agreement is subject to Turkish Law. In resolving disputes, an amicable settlement is preferred first; for consumer disputes, the Provincial/District Consumer Arbitration Committee (İl/İlçe Tüketici Hakem Heyeti) has jurisdiction (Law No. 6502). For cases exceeding the specified monetary limit, the Istanbul Anatolian Courts and Enforcement Offices (İstanbul Anadolu Mahkemeleri ve İcra Daireleri) are the competent courts. Under the scope of KGSTYY (Compulsory Personal Accident Insurance for Road Passenger Transport), compensation for death, disability, medical expenses, and temporary incapacity to work is covered. All guests are insured from the beginning to the end of the journey. The limit is determined annually by the Undersecretariat of Treasury.
Yes. Items you place in the vehicle's luggage compartment are our responsibility. In case of loss or damage, please report it with an official record within 72 hours; the value of the item will be reasonably compensated (Code of Obligations Art. 111). For highly valuable items (jewelry, electronics), prior notification and additional insurance are recommended; without notification, our maximum liability is limited to standard baggage limits.
Our chauffeur will not hesitate to ask about your condition; if you are seriously unwell, they will divert to the nearest medical center or call 112 (emergency services). There is no charge for this diversion, provided it is within a reasonable duration for the journey. In medical emergencies, the guest's health is the priority.
Pets (in a cage or carrier) and foldable bicycles can be transported free of charge if you specify them in your booking notes. A larger vehicle (e.g., a Sprinter) may be required for large animals or non-foldable bicycles, which would incur an additional fee. Dangerous animals (such as Pitbulls and other prohibited breeds) are not transported.
In accordance with Law No. 4207, smoking is prohibited in all our vehicles, including electronic cigarettes. If you need a break during the journey, please inform your chauffeur, and they can make a stop at a suitable location. If evidence of smoking is found inside the vehicle, a cleaning fee will be charged (minimum 500 TRY).
For airport transfers, we monitor your flight and will wait in case of delays at no extra charge. For all other locations, a 15-minute complimentary waiting period is standard. Longer waiting times will incur an additional fee, charged in half-hour or full-hour increments based on our hourly rate. If we cannot contact you after 30 minutes, the booking will be considered a no-show and cancelled without a refund.
