1. 1. Parties and Definitions

These Terms of Use ("Agreement") are entered into between Elemen Transfer Turizm ve Taşımacılık Hizmetleri (hereinafter "Elemen Transfer") and the natural/legal person using our website or services (hereinafter "User"). Service: refers to all services offered by Elemen Transfer, including but not limited to airport transfers, intercity transfers, city tours, premium vehicle rental with a chauffeur, and medical tourism logistics.

2. 2. User Obligations

• To be at least 18 years of age (parental consent is required for minors).
• To provide accurate, complete, and current information during the booking process.
• Not to make payments using card details belonging to someone else.
• To refrain from behavior that threatens the safety of the chauffeur and other guests.
• To refrain from behavior that could damage the vehicle's interior or equipment.

3. 3. Scope of Service and Our Obligations

As Elemen Transfer, our obligations are:

• Fixed price guarantee: No additional fees are charged after booking confirmation.
• To provide a vehicle with the specified guest capacity.
• To provide service with an insured, SRC-certified chauffeur.
• To monitor flights and automatically extend waiting times for delayed landings.
• To provide a 24-hour multilingual (17 languages) concierge line.
• To provide mandatory passenger liability insurance (KGSTYY) coverage.

4. 4. Payment Terms

All bookings are confirmed via secure online payment (Iyzico, Stripe, PayPal). The system is PCI-DSS Level 1 certified; full card details are never entered into our system. Accepted payment methods include:

• Visa, Mastercard, American Express credit/debit cards.
• Apple Pay, Google Pay (mobile wallets).
• BKM Express, Troy (local Turkish payment methods).
• Bank transfer/EFT (for corporate clients by prior arrangement).

Your invoice will be sent electronically to your registered email address; an e-Invoice is issued for bookings made by legal entities.

5. 5. Cancellation and Refunds

For detailed conditions, please see our Cancellation and Refund Policy page. In brief:

• Free cancellation up to 24 hours before the scheduled pickup time.
• Cancellation between 24 and 6 hours before pickup: 50% refund.
• Cancellation less than 6 hours before pickup or no-show: no refund.
• Cancellations initiated by us (e.g., vehicle malfunction, chauffeur unavailability): 100% refund.

6. 6. Limitation of Liability

The total financial liability of Elemen Transfer shall not exceed the amount paid for the respective booking (BK m.114). We are not liable for:

• Delays or failures resulting from guest error (e.g., late arrival, incorrect address, missing information).
• Cases of force majeure (e.g., natural disasters, pandemics, road closures, adverse weather conditions).
• Delays caused by third parties (e.g., airport authorities, police, customs).
• Items forgotten or lost by the guest (a separate Lost and Found procedure applies).

7. 7. Dispute Resolution and Governing Law

This agreement is subject to the laws of the Republic of Turkey. In the event of a dispute, the parties will first seek an amicable settlement. For consumer disputes, in accordance with Law No. 6502, the İl/İlçe Tüketici Hakem Heyetleri (Provincial/District Consumer Arbitration Committees) have jurisdiction. For disputes exceeding the statutory limits or involving legal entities, the İstanbul Anadolu Mahkemeleri ve İcra Daireleri (Istanbul Anatolian Courts and Enforcement Offices) are designated as the competent jurisdiction. If any provision of this agreement is deemed invalid, the remaining provisions shall remain in full force and effect (the principle of severability).
